Article 1 – Definitions

In these terms and conditions, the following definitions apply: Reflection period: the period within which the consumer may exercise the right of withdrawal. Consumer: a natural person not acting in the course of a profession or business who enters into a distance contract with the entrepreneur. Day: calendar day. Duration transaction: a distance contract relating to a series of products or services. Right of withdrawal: the right of the consumer to withdraw from a distance contract within the reflection period. Entrepreneur: Retail Equipment Europe B.V.

Article 3 – Applicability

These terms apply to all offers and distance contracts between the entrepreneur and the consumer. Before the contract is concluded, the consumer is provided with these terms in a way that allows them to be saved. Invalid provisions are replaced by valid ones closest to the intent of the original provision.

Article 4 – The Offer

All offers contain a complete and accurate description of the products, including true-to-life images. Pricing includes VAT and applicable shipping costs. The offer specifies the withdrawal rights, payment methods, delivery terms and the duration of the offer.

Article 5 – The Agreement

The agreement is concluded when the consumer accepts the offer. Electronic acceptances are confirmed immediately. The entrepreneur may verify the consumer's creditworthiness and may refuse orders within legal bounds, providing clear reasons.

Article 6 – Right of Withdrawal

Products: The consumer has 14 days from receipt to withdraw from the agreement without giving reasons. Products must be returned in their original condition and packaging. The notice of withdrawal must be given within the 14-day reflection period; the return must be completed within 14 days thereafter.

Services: The consumer may withdraw within 14 days from the date the agreement was concluded.

Article 7 – Costs in Case of Withdrawal

The consumer bears the return shipping costs. Refunds are processed within 14 days using the original payment method. The entrepreneur may deduct value for damage caused by careless handling if proper withdrawal information was provided.

Article 8 – Exclusion of the Right of Withdrawal

The right of withdrawal may be excluded for: custom-made or personalised products; sealed products that cannot be returned for hygiene reasons once opened; products whose price depends on fluctuations in financial markets; newspapers and periodicals; digital content once delivery has started with the consumer's consent; services whose performance has begun with the consumer's consent.

Article 9 – The Price

Prices are fixed during the offer period, except for changes resulting from changes in VAT rates. Products or services with prices subject to fluctuations in financial markets are identified as such. Price increases within three months of the agreement require a legal or regulatory basis. Price increases after three months entitle the consumer to terminate the agreement. All prices include VAT.

Article 10 – Compliance and Warranty

The entrepreneur guarantees that products conform to the agreement, the specifications in the offer, and applicable legal requirements. Defects must be reported within two months of discovery. Warranty excludes damage caused by the consumer, abnormal use, or circumstances beyond the entrepreneur's control.

Article 11 – Delivery and Execution

Orders are executed within 30 days unless a different period has been agreed. If delivery is delayed, the entrepreneur notifies the consumer within 30 days, allowing the consumer to cancel the order without penalty. Delivery dates are indicative only. If delivery proves impossible, a replacement item is offered at the entrepreneur's expense. Risk transfers to the consumer upon delivery.

Article 12 – Duration Transactions

Termination: The consumer may terminate an indefinite-term contract at any time with one month's notice. Fixed-term contracts may be terminated at the end of the term with one month's notice, using the same method as enrolment.

Extension: Fixed-term contracts do not automatically renew for a fixed period. Periodical subscriptions (e.g., newspapers) may be renewed for a maximum of three months with a one-month cancellation right.

Duration: Contracts lasting more than one year may be terminated annually after the first year with one month's notice.

Article 13 – Payment

Payment is due within 7 working days after the start of the reflection period. The consumer must report inaccuracies in payment details immediately. In the event of default, the consumer may be charged reasonable collection costs.

Article 14 – Complaints

Complaints must be submitted within two months of discovering the defect. The entrepreneur responds within 14 days. Justified complaints result in free repair or replacement. Unresolved complaints may be escalated via the European ODR platform.

Article 15 – Disputes

Dutch law applies exclusively to all agreements. The Vienna Sales Convention (CISG) is excluded.

Article 16 – Additional or Different Provisions

Any provisions deviating from these terms must be recorded in writing or in a durable medium and must be to the benefit of the consumer.
